Rules of the Betting Game of Chance

Based on Article 51, paragraph 1 of the Law on organizing the game of chance and prize games (NN 83/02.) and Article 12, paragraph 1 of the Rulebook on organizing betting games (NN 167/03), FORTUNA SPORTSKA KLADIONICA d.o.o. represented by the President of the Management Board, Petr Krafka, and the Member of the Management Board, Antonin Laš, on June 30, 2009 are defining the cleansed text of Rules of the betting game of chance

Article 1.

These Rules regulate the terms of organizing a betting game betting (hereinafter: betting) set by FORTUNA SPORTSKA KLADIONICA d.o.o. Ulica grada Vukovara Street 271, Zagreb (hereinafter: organizer)

Article 2.

Betting games are games of chance which imply:

• placing bets on individual or group sports results
• placing bets on the outcome of dance, singing, music or similar competitions
• other bets

Betting is a game in which a player guesses the outcome of sporting and other events offered by the organizer, and the sum of possible winnings is determined by the exchange rate and the betting sum.

Winning or losing is decided on by chance or by predetermined unknown circumstance or event afore-mentioned by the organizer’s predetermined terms of playing.

Betting is a continuously organized game.

Article 3.

These Rules are an exclusive legal basis for concluding an agreement on game participation (the Access Agreement).

The Agreement from paragraph 1 is concluded between the organizer and the participant (player) on the basis of accepting the offer given in these Rules, and the participant’s free will expressed by the act of buying a betting ticket.

Participation in the game (betting) implies that the player had accepted the Rules of the game, so ignorance of the regulations or their subjective interpretation will not be taken into consideration in case of dispute.

All parties entering into contact on the occasion of organizing a betting game of chance have to abide by these Rules (organizers-a person authorized for accepting bets, participants-players, and the third party).

Article 4.

Anyone under 18 does not have the right to place any bets, and the organizer’s employees are forbidden to participate in the game.

For the purpose of access and betting barrings for people under 18 the organizer’s employee may ask an identity document.

Article 5.

Participant in betting is an individual with whom the organizer concluded the agreement from Article 3 of the Rules, of which they have a certificate of the amount paid (hereinafter: bet slip).

All the betting data are written on the organizer’s magnetic medium before printing the very bet slip.

Article 6.

Bet placements on the territory of the Republic of Croatia are accepted in offices for which the organizer got the Approval of the Ministry of Finance.

Article 7.

Individuals (players) who do not accept these rules or, with their behavior, are not obeying the house rules, can be permanently or temporarily forbidden or limited to participate in betting by the organizer.

Article 8.

These Rules are placed in every betting shop and published on the organizer’s web site. The organizer’s obligation is to make possible for individuals interested in participation in betting to get familiar with these Rules.

Article 9.

The organizer accepts bet placements on events published in the betting list. Every event on the betting list has a certain rate (hereinafter: odds) set by the organizer.

The odds rate for every event is determined by the organizer’s judgement, taking into consideration information about teams or individuals involved in a certain event.

The winnings’ value on a single ticket is calculated by multiplying the event’s odds and the betting sum.

Article 10.

The organizer publically announces the betting list every time before starting to accept the bet placements. The betting list contains at least the following data:

• event number;
• name(s) of participant(s);
• date and time of the event’s beginning;
• type and odds’ rate for every type of event;
• possible limited number of combinations;
• league or competition type name;

The data on the betting list are for information only. In case of error or change on the betting list the organizer takes into consideration the data given at the moment of placing the bet.

Article 11.

Amounts paid for participation in betting are accepted on a bet slip. Shortened organizer’s company name, KB (internal control number), day, time of bet, boxes for events and types, total odds, the bet placed, possible winnings, percentage and the amount of manipulative expenses, and the sum of betting amount plus manipulative expenses are specified on the bet slip. /p>

Article 12.

For separate events the organizer sets different bets, depending on the type of event. For separate event types the following bets are possible:

• on the event’s winner (type 1 the first one listed wins, type X a draw, type 2 the second one listed wins, or a combination of types ili 1X, X2 or 12);
• on the event’s winner with handicap (assumed advantage of one team);
• on the exact partial or final result of the event;
• on an individual’s win;
• on the ranking or placing;
• on the first score of the event (team or player);
• on the total number of points scored in the game;
• on the combination of different events;
• on an individual’s or team’s advance to the next round in cup-like competitions;
• other types of betting according to the organizer’s offer;

Article 13.

On a single bet slip one can bet on one or at most 50 events, which are published on the betting list. The player can change or cancel the bet placed within 5 minutes after placing the bet if none of the chosen events had started yet, so the player is obliged to check the bet slip immediately. After that period of time or after the beginning of some event chosen, the participant cannot change or cancel the placed bet.

The participants have the right to winnings payment if they have properly predicted the outcomes of all events on the bet slip.

For bets that are not valid (ineffectual) the odds are set to 1,00. If the bets on the ticket are not valid for all events, the participant has the right to the recovery of the sum waged.

Article 14.

Combination bets are also possible, where the participant combines the events on one bet slip, and the computer makes the combinations of all individual bets. On the first ticket there is a review of events combined and that bet slip serves as proof of betting amount placed and also for collecting the winnings. Other bet slips contain a detailed overview of the combination played with the bet placed, coefficient and possible winnings for each combination.

LUCKY LOSER
“Lucky loser” is a type of bet with predetermined minimal overall odds and predetermined maximum odds of a single event. The player wins the bet even if the outcome of only one event on the bet slip is missed. In that case, the winnings are calculated as the betting amount times the predetermined fixed odds for this type of bet.

EXPERT
“Expert” is a bet consisting of events which were predetermined by the bet organizer. The organizer sets the bonus rate for every “EXPERT” betting cycle. In case of guessing correctly all the winning outcomes, the player has the right to winnings just like with a regular bet, and also to a bonus set by the organizer. If there is more than one winning bet slip in a single “Expert” cycle, the bonus is divided according to the betting amount rate on separate winning bet slips. If any of the “Expert” bet events is postponed or stopped, but is played within next three days by midnight, the bet is treated like it does not contain that event, that is, the odds are set to 1,00. If more than one event within the “Expert” bet is postponed or stopped, the organizer will not pay out the bonus.

Article 15.

Minimal betting amount per single bet slip is 2,00 kuna.

Minimal betting amount for one combination in case of a system bet is 1,00 lipa. Maximum betting amount for a single bet slip is limited in a way that the winnigs of certain odds cannot be bigger than 300.000,00 kuna, and on a system bet slip maximum winnings cannot be bigger than 600.000,00 kuna.

Maximum winnings made by betting on lotto draw is1.000.000,00 kn, regardless of whether it is a regular or a system bet slip.

With every bet the organizer charges manipulative costs on the betting amount rate in the amount specified on the bet slip.

Article 16.

The organizer stops with accepting bets for certain events not later than 1 minute before the event’s beginning set on the bet slip, due to the time needed for possible cancellation. All dates, times and odds published by the organizer may change at the moment of accepting bets. All bets are placed at the original time of the match (with matches that have fixed time), if not specified otherwise.

At a certain moment or for a certain event, the organizer has the right to limit the betting amount rate or the number of combinations or reject to accept the bets in the event of things specified in Article 4 (paragraph 1) and Article 7, and also if the event has already begun, if a mistake was found in the odds set, or if, due to justifiable reasons, normal course of betting and the organizer’s interest are jeopardized.

After result processing the organizer announces the scores of the finished events at the betting shops.

While taking the bets the organizer has the right to change the odds. However, from the moment the bet is confirmed and paid for, the odds are binding for the participant and the organizer regardless of subsequent change, except if the bet is not valid – ineffectual.

If the organizer takes a bet after the start of an event or after it had finished, the bet for that event is not valid and the odds are set to 1,00 because the circumstances deciding on the winning cannot be known in advance by anyone.

In case of an error on the organizer’s betting list, in a way that the time or date of an event is earlier than the real ones, the bets will be valid.

In case of an error in printing, error on the bet slip or an obvious error in transferring data into organizer’s computer, the organizer will set the odds to 1,00.

In case of a minor error in the name of one of the event’s participants (e.g. Barcelona – Barcalona), which does not effect the essence of the bet nor the score, the bet is valid. The bet is not valid if such an error would affect its essence (e.g. Real M. – Real S.).

If the data of informative nature (such as type of surface in tennis, the score of the first leg etc.) that functions as a help for clients is incorrect, the bets will be valid.

In case of betting on the final standings or ranking, if a client predicts more types than it is achievable (e.g. 3 second places) the bet will be valid.

Article 17.

For correctly predicted bets on sports events and other betting, the organizer takes into consideration the events, in which the following regulations have been considered:

FOOTBALL

As the score of the event, the outcome set in a regular time specified by the rules of the competition is always taken into account, except if the organizer when making the offer sets the final result to be the score. No further changes, decisions of individuals or committees will be taken into account.

If the event has been cancelled, postponed or stopped before the end of regular time, and has not been continued within the following three days until midnight, match venue local time, the bet on that event is not valid and the odds for that event are set to 1,00 and no further changes, decisions of individuals or committees will not be taken into account.

Betting on red or yellow card during the game refer specifically to the players which are in the game at that time (the players and other staff on the bench are not considered)

The exception is betting on the parts of the match which would not change even if the match finished in regular time, for example the match was stopped in 58th minute with the score 1:0, then the allowed parts of the game are home team scores, first half and first goal. For other parts of the match (handicap, 3 goals, away team scores, half time/full time) the odds are set to 1,00.

In case of change of the event's venue, not announced by the organizer, the event is valid except in the case of the host switch when the odds are set to 1,00.

If the bet is on the scorer of the first goal, and that player does not participate in the game or come in after the first goal has been scored, the bet is not valid and the odds are set to 1,00.

If the bet is on the scorer of the last goal, and the player does not participate in the game, the bet is not valid and the odds are set to 1,00.

AMERICAN FOOTBALL, BASKETBALL, HANDBALL, HOCKEY, VOLLEYBALL

As the score of the event, the outcome set in a regular time specified by the rules of the competition is always taken into account, except if the organizer when making the offer sets the final result to be the score. No further changes, decisions of individuals or committees will be taken into account.

If the event has been cancelled, postponed or stopped before the end of regular time, and has not been continued within the following three days until midnight, match venue local time, the bet on that event is not valid and the odds for that event are set to 1,00, except in case of bets on team or player to make the first point, first half, first third or first quarter, if they were finished.

In case of change of the event's venue, not announced by the organizer, the event is valid except in the case of the host switch when the odds are set to 1,00.

BASEBALL

As the score of the event, the outcome set in a regular time specified by the rules of the competition is always taken into account, except if the organizer when making the offer sets the final result to be the score. No further changes, decisions of individuals or committees will be taken into account.

If a baseball game is not going to be played on the announced day for whatever reason, or it was stopped and the score at that time was not made official, the odds are set to 1,00.

If the game is stopped and the bet is on the part of the game (more/less), and if the number of points scored before the stopping is above the limit the chosen odds are valid. If the number of points is below the limit, the bet on that event is not valid and the odds are set to 1,00.

If two teams are about to play two games in the same day, if it is not specified differently the offer is made for the first one (the game to be played first), and the score of that game is considered. The result of the second match will not be taken into account.

In case of change of the event's venue, not announced by the organizer, the event is valid except in the case of the host switch when the odds are set to 1,00.

LOTTO

The organizer can offer bets on lotto numbers draws from lotteries in the world, as published in the betting list, except bets on the numbers drawn in the lotto of the state lottery on the territory of Republic of Croatia.

As the result of the event the official results of the respective lottery draws are specifically taken into account, and only the basic numbers. The additional numbers will not be taken into account.

The bets can be made until 1 minute before the specified start of the draw.

Any bets made after the real start of the draw will not be valid, and the amount paid for the bet will be returned to the participant.

If two lotto draws of the same lottery are made in the same day, the results of the main (first) draw (draw A) are taken into account, unless it was specified differently.

If the lotto draw (or draws) is not held for whatever the reason, the bets are not valid, and the amount paid for the bet will be returned to the participant.

The maximum number of numbers for making a bet on is 5 (five).

Organizer’s Terms of the game apply on all the situations specified in the lottery rules.

TENNIS

The score of the event is considered to be the final result, given by the first official announcement.

If the players finish the match earlier due to withdrawal of one of them (injury, forfeit, disqualification...) the bet if not valid, that is the odds are set to 1,00.

If the event is cancelled before the start due to withdrawal of one of the players, the odds are set to 1,00.

If the event has been stopped and was not continued before the official end of the tournament, the odds are set to 1,00, and if the event has been stopped and was continued before the end of the tournament, the odds in the bet are valid.

In the case of stopping the match or forfeit, the bets on parts of the match (more/less) like games, minutes, sets, aces, double faults and the like, and when before the stopping or forfeit the number of games, minutes, sets, aces, double faults and the like was above the limit, the odds in the bet are valid. If the number of games, minutes, sets, aces, double faults and the like is under the limit and the match was not continued before the end of the tournament, the bet on this event is not valid and the odds are set to 1,00.

In case of the withdrawal of one of the players after the start of the match, the odds in bets on handicap are set to 1,00.

If the bet is on the result of the first set, if the match is stopped during the first set, the odds are set to 1,00.

SKIING AND SKI-JUMP

The score of the event is considered to be the standings given by the first official announcement. No further changes, decisions of individuals or committees will be taken into account.

If not specified differently, all bets are made for the competition or the finals.

If a registered competitor forfeits before the start of the competition, the odds are set to 1,00.

If the event was cancelled, postponed or stopped before the end of regular time and has not been continued until midnight the next day, event venue local time, the bet on this event is not valid and the odds are set to 1,00, and no further changes, decisions of individuals or committees will be taken into account.

In case of ‘’who is better’’ (DUEL) type of betting, qualifying rounds do not count as part of the competition. Therefore, if the better standing bet is offered for two competitors, and one of them does not enter the final round, the bet is not valid and the odds are set to 1,00.

In case of change of the event's venue, not announced by the organizer, the bet is not valid and the odds are set to 1,00.

If the competitor forfeits or is disqualified during the event, it is considered that he participated in the event.

COMPETITIONS FEATURING HORSES, CARS, MOTORBIKES, BOATS AND BICYCLES

The score of the event is considered to be the standings given by the first official announcement. No further changes, decisions of individuals or committees will be taken into account.

If the event was cancelled, postponed or stopped before the end of regular time and has not been continued within the next three days until midnight, event venue local time, the bet on this event is not valid and the odds are set to 1,00, and no further changes, decisions of individuals or committees will be taken into account.

If the competition has been cancelled due to forfeit of one of the competitors, the odds are set to 1,00.

If the event is continued and if it ends on the same track, and if it has been continued before midnight the next day, event venue local time, the odds in bet are valid.

In case of change of the event's venue, not announced by the organizer, the bet is not valid and the odds are set to 1,00.

If the competitor forfeits before the start of the event, the odds are set to 1,00.

If the competitor enters the track for warming up or the test lap, and does not start the race, he is not considered to be a race participant.

For the F1 qualifying rounds results the first officially published results are taken into account (they are not necessarily same as the starting positions – POLE POSITION)

If the competitor forfeits or is disqualified during the event, it is considered that he participated in the event.

When the bet is on the victory of an individual – the duel, if both competitors forfeit during the event and one or both achieve an official ranking, the winner is the one that achieved better official ranking, in compliance with the rules of the event. If the competitors have forfeit and did not achieve an official ranking in compliance with the rules of the event, the odds are set to 1, 00 regardless of the time the forfeit occurred.

For a type of betting ends/does not end the race an official ranking in compliance with the rules of the event is considered (for example in F1 this means finishing 90% of laps).

COMBAT SPORTS

The winner of the event is considered to be the competitor who was declared a winner after the end of the event.

If the competitors end the fight earlier due to withdrawal of one of them (injury, forfeit, disqualification...), their opponent is considered a winner and the odds are valid.

If the event was cancelled, postponed or stopped before the end of regular time and has not been continued within the next three days until midnight, event venue local time, the bet on this event is not valid and the odds are set to 1,00, and no further changes, decisions of individuals or committees will be taken into account.

If the competitor forfeits or is disqualified during the event, it is considered that they participated in the event.

If the event is stopped and is not continued until midnight the next day, event venue local time, the odds are set to 1,00.

ATHLETICS

The score of the event is considered to be the standings given by the first official announcement. No further changes, decisions of individuals or committees will be taken into account.

If the event was cancelled, postponed or stopped before the end of regular time and has not been continued within the next three days until midnight, event venue local time, the bet on this event is not valid and the odds are set to 1,00, and no further changes, decisions of individuals or committees will be taken into account.

If not specified differently, a bet on a duel between competitors is considered valid if at least one of them entered the final race, if not, the bet is not valid and the odds are set to 1,00.

If the event was cancelled before the start the odds are set to 1,00. If the competitor forfeits or gets disqualified during the event or does not qualify for the finals, they are considered to be participating in the event.

In case of change of the event's venue, not announced by the organizer, the bet is not valid and the odds are set to 1,00.

GOLF

The score of the event is considered to be the standings given by the first official announcement (which also applies if the match is played on just 15 out of 18 holes). No further changes, decisions of individuals or committees will be taken into account.

If the event was cancelled, postponed or stopped before the end of regular time and has not been continued within the next three days until midnight, event venue local time, the bet on this event is not valid and the odds are set to 1,00, and no further changes, decisions of individuals or committees will be taken into account.

If the event was cancelled before the start due to forfeit of one of the competitors, the odds are set to 1,00.

If a competitor forfeits or gets disqualified during the event, they are considered to be participating in the event.

In case of change of the event's venue, not announced by the organizer, the bet is not valid and the odds are set to 1,00.

OTHER SPORTING EVENTS AND OTHER BETS (golf, chess, darts, rugby, snooker, floorball, presidential elections, beauty contests etc.)

For other sporting events and other bets, bearing in mind their special features, the rules of these Terms provided for sports with defined or undefined duration are properly applied. If there are variations to these rules, the organizer will post them on the betting list.

RANKING

In case of bets on the overall ranking, if more than one competitor is ranked on the same position, the betting sum is divided by the number of the competitors ending up on the same position. The bet calculated in this manner is multiplied with the winning odds, for every competitor with the same ranking respectively.

Article 18.

LIVE BETTING

The organizer can organize betting during an event (live betting) in some betting shops in which it is technically possible to provide live TV coverage of the event.

In live betting the following bets are possible:

• On event winner
• On first point of the event or the point to come next
• On the event winner with handicap (assumed lead of one team or player)
• On the winner of a part of the event (half time, quarter, set etc.)
• On the winner of the second half of the event
• Who will proceed into the next round
• On the standings of the participants
• And other possible parts of the match

One ticket can contain only one of the offered events and only one outcome of the event’s progress.

The live betting odds are usually displayed using electronic medium (teletext, infochanel)

If the match is stopped (fan riots, bad weather, injuries etc.) valid are the bets concerning the part of the event that has ended before the stopping (first goal, first set, first quarter, first half etc.). Other bets are valid for the next thirty minutes if the event is continued within that period, and if the bet does not get continued in the mentioned period, the bet is not valid and the odds are set to 1,00.

In case of termination of the TV coverage (there is no TV image of the event), all taken bets are valid.

The bet is closed at the moment the bet slip is printed, and the client cannot change or withdraw (cancel) the bet after it was closed.

The odds that were valid at the moment the bet was taken may be changed when the bet slip is in print. In that case, the odds written on the ticket are valid.

The winnings can be collected in any Fortuna betting shop, usually within 15 minutes after the event or its part has ended.

The right to collect the winnings from live betting expire 30 days after acquiring that right.

Article 19.

The organizer will publish the type and the score of an event not later than seven (7) days after the end of the event. The scores of the finished events are publicly published by the organizer.

For paying out the winnings, only the official scores, that is the scores published in the organizer’s betting shop, are taken into account.

Article 20.

The winnings can be collected in any of the Fortuna sportske kladionice d.o.o. betting shops, and the organizer is obliged to pay out the winnings not later than 14 days after the official score publishing.

While claiming the right to winnings, the client must present their personal ID if asked by the organizer. Otherwise the organizer has the right to withhold the winnings until that term has been met.

The organizer can, if it wishes to do so, pay out certain amounts of winnings onto the client’s account.

Article 21.

The right to collect the winnings expires 60 days after acquiring that right.

Betting participant has the right of complaint in the period of 15 days starting on the day the first official results were published. The complaint is filed on a form available in the organizer’s betting shop, sent by registered mail to the organizer’s address. The complaints received outside the proscribed period will not be taken into consideration.

The complaints are resolved by an organizer’s commission who informs the client of the decision within 15 days.

Article 22.

The winnings are paid out on the basis of presented winning and undamaged bet slip. The winning bet slip can be paid out only once, and in case of bet slip misuse or the attempt to counterfeit it the right to winnings is lost.

Undamaged bet slip is a ticket that completely contains all the elements listed in article 11 in this Rules.

In case of bet slip damaging the client could get the right to winnings only after the organizer’s commission has reached the decision.

Article 23.

The organizer publishes the final report on the scores in the past week’s competitions, betting list for the current week, statistics and a review of the leagues in competitions that are subject of betting, in betting shops or on the web site.

Article 24.

The organizer is obliged to keep information on the clients secret, except when the client gives consent to publishing their information, or when requested to publish the information by an authorized government agency.

Article 25.

The organizer is responsible by all its assets for the obligations towards clients, if the terms in these Rules are met.

Article 26.

The Zagreb county court is locally and actually authorized to settle the disputes which may arise from participating in the game of betting.

Article 27.

These Rules come into effect on the day they were issued, and are implemented since the day following the day when they get approved by the Republic of Croatia’s Ministry of finance.

On the day of the implementation, the Rules of betting game of chance, conclusion no. 6/2002. dated December 30, 2002, and all the connected amendments and additions cease to apply.
